Mechanics lien

I came across these mechanics that asked me if I notarized Mechanics liens. They said that their last notary prepared the docs and notarized them himself. I guess my question is, in Texas you can’t prepare docs and notarize them, can you? Thanx Ernie |

Maybe the last Notary was not only a Notary by also a paralegal and works in a law office. Check your state’s notary handbook. Typically, though, Notaries do not get involved in preparing docs as this is considered practicing law. Louisiana Notaries are the exception as they are in a civil law state as opposed to a common law state (like the rest of us). Call the Texas SOS. |

Ernie – what the gentleman meant was this his employee notary prepares the doc for him and notarizes it—this is perfectly legal since the person named in the doc is not the notary. |

I’ve been hired as an administrative assistant to prepare Grant Deeds and Releases of Lien documentation. In addition to preparing them, I also notarized them. Anyone can prepare a document for his or her own use. If that individual owns a business, they can hire someone to draft the document under his or her supervision. |

Sorry it took so long to get back to this. The notary created, prepared and notarized the doc, and no he wasn’t a paralegal. Thanx for the response Ernie |
